In their frenzied haste to do away with President Trump, some members of Congress plan to pass legislation stating that he committed the crime of insurrection on January 6, 2021.
This is expressly forbidden by the US Constitution, as it would be a "bill of attainder":
Article I, Section 9
3. No Bill of Attainder or ex post facto Law shall be passed.
I believe that Section 5 of the 14th Amendment does NOT override Article I, Section 9, para. 3 of the main document. Congress can now pass legislation defining how to implement Section 3 of the 14th Amendment, but Trump would first have to be convicted of the appropriate crime in a court of law, with all the benefits of due process.
It would be nice if our Representatives and Senators would take the time to read, understand, and follow our Constitution ... all of it.
