The US government can monitor journalists under a foreign intelligence law that allows invasive spying and operates outside the traditional court system, according to newly released documents.
Targeting members of the press under the law, known as the Foreign Intelligence Surveillance Act, requires approval from the Justice Department’s highest-ranking officials, the documents show.

I guess the people in Congress and at DOJ forgot to read these words:
US Constitution, 1st Amendment
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Wouldn't you say that using FISA this way appears to violate that amendment? I would.
Oh, wait ... the US Constitution was suspended on September 11, 2001, a state of affairs which has been renewed annually ever since then. "Our" constitution no longer applies.
